My policy was on auto pay meaning that the payments were taken directly from my account. He walked in to pay his. About 6 months after the divorce, I was pulled over for a routine traffic stop and was told I was driving an uninsured vehicle. Without insurance, my registration was also invalid. Both tickets totaled 1K. My car was taken into impound. I checked and found the officer was correct. On good terms with my ex, I told him what happened. He said for the past 6 months, each time he went in to make a payment, the girl HIS was already paid. Realizing what had happened. They were applying my payments to his automobile. I was furious. I notified the agent who initially did not want to accept blame, but since the payments were automatic and my account number was on each payment they took, they were responsible. The error was compounded by the fact that the cancellation notice went to HIS address (how dumb was that!) So I had no way of knowing that I was cancelled. I was without a car for 2 weeks and lost my job. After much haggling and many sleepless nights of wondering what to do without a job or a car, the insurance company finally admitted blame, paid the impound fees of $1,250.00. The agent also said they would handle the 2 tickets totaling 1K. FAST FORWARD TO 2010 in my state, the county did a scofflaw sweep and I was summoned to court with over 5 thousand other delinquent drivers to address unpaid tickets. The order was come to court by April 30th or be arrested. Realizing this had to be a mistake, but fearful of the law, I stood in line for over 5 hours in blazing heat, then sat in court another 5 hours waiting for my day in court. I was immediately threatened with arrest because the 2 tickets were not paid. Up to that moment, I had no idea the insurance company had not paid the 2 tickets. This time, not only was my insurance and registration cancelled, my license was suspended due to the age of the infraction (5 years). In front of the judge, I called the agents' office only to be told by the secretary that they had no intention to pay the ticket. Paying to get the car out of impound was enough. When the judge heard this she was shocked and let me off with a promise to pay in 5 days. She made me promise not to drive. With no way to get home but drive, I took a chance, and was pulled over. The officer informed me that due to the vast number of outstanding cases, tags bearing our county name would be targeted for a while (talk about a police state!). I showed him my documents from the court and headed home. This is a nightmare. Would I have a case if I filed suit against my insurance company for failing in their fiduciary responsibility to a 16 year client in good standing? By the way this company is one of the largest in the country.

Back in October of 2010I was involved in a Hit and Run Accident. The Guy that hit us was found a few days later and we filed against his insurance. Me and my Fiance both went through Physical therapy for our backs. Medical bills totalled about 5K for me and about 8K for her. There were times when she was in tears because her back was hurting so bad. She Couldnt work some days either and she is self employed and works from home as a graphic Designer. I missed some days of work too but my pain was not near as much as hers. State Farm Called and offered a settlement with me to pay the 5k to the Doctor and then a $1000 check to me for my pain and suffering. They called my Fiance to settle but she did not answer. My guess is they will probably offer her the same. Is Paid medical bills plus $1,000 fair? We missed work from it. Delt with stress and Physical therapy for about 3 months and not to mention all of the inconveniences associated with getting the car fixed and also dealing with insurance stuff. The guy that hit us was found a few days later but never offered a good excuse as to why he hit us and then ran. He originally filed a false claim with State Farm and said that he hit a tree and not another vehicle. It was all overturned against him once Geico called them and submitted the police report. Should I get a lawyer? I honestly feel like we should be getting more. Especially my Fiance but if it's fair It's fair. Can anyone help?

My step father auto was struck in th readend by a teen the other day. Now his car is not worth much. Maybe 1500 dollars. The 2 body shops gave repair estiments at 2700 and 4300. Now as this is his personnel car and gets 45 miles to the gallon you can understand why he wants to keep using it to get to work. From a legal standpoint, as this is a personnel auto and the other driver is required to carry general libility to cover damage to aother peoples autos. How is it they can require a third party to settle on there terms? As he is not the orginator of the policy, he did not enter into a contract with the insurance provider. Let's say for the sake of argument that my car is valued at 2000.00 at the beginning of this year and my full coverage insurance on this vehicle is 500.00 a year. My insurance company wants to use reconditioned parts, and they are pressuring us to accept a check made out to us and the finance company. Not enough to pay it off or fix it. My vehicle is a loaded Suzuki Grand Vitara with all kinds of electronic stuff. Which were mostly scattered across the road after the deer committed suicide. They (the insurance company) had it towed to my home after the accident because there were no dealers in the area and my home was about 100 miles closer than Dallas. They are also saying that we contacted the towing company and they are the ones who arranged the tow. There is no one local (car repair shop) who can work on it and get it right. I need to find a lawyer who can make them fix it right. If it can't be fixed right then I need them to total it. I have looked in the yellow pages and all of the accident attorneys want injuries. What kind of attorney do I need for just auto damage? I have never sued anyone before. HELP!!!

I have full coverage on my part, however fault being hers i made a claim to insurance she provided to police report. the thing is that the owner of vehicles insurance policy does not have person b listed on that policy but person b has same home address as policy holder so technically theyre insurance will not cover me. they have restricted non standard policy, and i do not have uninsured motorist coverage on my policy nor car rental coverage. their insurance is investigating this in he meanwhile so they say. i am not sure whether i should get my insurance to handle this, if i do i would have expect higher premium, pay deductible, rental car and medical fees out of pocket. I am wondering if i should have patience or start looking for a lawyer and forget my own insurance.

Hello, I have two questions. First some info though, I live in Southern Md and am a 24 year old male who currently has a completely clean driving record. Right now I have full coverage with Allstate and am paying around 200/month. My question is how much should I expect my rates to jump if I get lets say a lower powered motorcycle ~$7500. Does the age of the motorcycle have much bearing on the rates? And now my more obscure question...What about an electric motorcycle at $15000? The only reason I thought it might be lower is in general they are simpler to operate, not as powerful, and have few breakable parts. Thank you
